Use of Services

• You must use our services in accordance with all applicable laws and regulations.
• Access to certain areas (such as the admin section) requires authentication via Firebase Auth. You are responsible for maintaining the confidentiality of your login credentials.

Contracts & Payments

• Customers who sign a contract with Hyper Monkey are required to comply with all terms outlined in the agreement.
• Payments must be made in a timely manner as specified in your contract.
• Failure to pay, lack of communication, or inappropriate behaviour may result in suspension or cancellation of services and contracts at our discretion.
• We reserve the right to cancel contracts at any time for reasons including, but not limited to, non-payment, breach of contract, or misconduct.

Subscriptions & Ongoing Fees

• Some services, such as hosting, domain registration, or third-party tools, require ongoing monthly or annual payments. These fees are separate from our service fees and must be paid directly or via Hyper Monkey as agreed.
• In addition, we charge a separate monthly maintenance fee for ongoing support, updates, or management of your website, app, or system. This fee is distinct from hosting/domain/tool costs.
• Failure to pay any required subscription or maintenance fees may result in suspension or termination of services.

Intellectual Property & Rights

• Unless otherwise agreed in writing, all intellectual property rights in any code, designs, documentation, or deliverables produced by Hyper Monkey remain the property of Hyper Monkey. Upon full payment, the client is granted a non-exclusive, non-transferable license to use, modify, and deploy the deliverables for their intended purpose, excluding any third-party components or open-source libraries, which remain governed by their respective licenses.
• Hyper Monkey retains the right to reuse, adapt, or incorporate any code, components, or design elements—whether proprietary or open-source—into other projects or websites, regardless of ownership, provided such reuse does not disclose or compromise any confidential client information.

Limitation of Liability

To the fullest extent permitted by law, Hyper Monkey shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, data breaches, data leaks, hacks, loss of profits, or business interruption, arising out of or in connection with the use of our services or deliverables. Our total liability for any claim arising from these Terms or our services is limited to the amount paid by you for the relevant services, up to a maximum of one year of payments.

Warranties & Disclaimers

We provide our services and deliverables using reasonable skill and care, consistent with industry standards. Except as expressly stated in your contract, all services and deliverables are provided "as is" and without any other warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

Governing Law

These Terms & Conditions are governed by the laws of England and Wales. If our servers or data are located abroad, the laws of that jurisdiction may also apply as required by local regulations.

Prohibited Services

We do not provide services for projects or content that involve violence, pornography, gambling, or any illegal or unethical activities. We reserve the right to refuse or terminate service at our sole discretion if a project is found to violate these principles.
